Collection and use of personal information All personal information is used by Moxja for order confirmations and project presentation only. When you place your on-line logo design order we need to know your name, your company's name, your mailing address, your phone number and your email address. This information allows us to process your order, and to inform you about your order status. We also need certain information about your company in order to understand your company's logo design needs. We will not share your personal information or information about your company with any third party.
Copyright If you don’t make the appropriate payment, it is strictly prohibited to copy or otherwise use any design concepts presented to you. All the rights to the final logo design and/or related design products we create at your request belong to you after the invoice is settled. Moxja reserves the right to publish any logo and/ or related design product created for you as a design sample. Protection of your logo copyright is your responsibility. Moxja does not file a trademark application with respect to the logos produced for you. So, you may wish to register your logo as a trademark yourself.
Creative Brief and Revision Briefs. You are solely responsible for preparing and posting detailed descriptions of each of your Creative Brief and Revision Briefs. Moxja is not responsible for extra needed revisions due to inaccuracy, incompleteness of information, or lack quality or clarity from the client. If Moxja accepts a verbal order or brief from the client, Moxja will not be held responsible for any mistakes (made by either party) arising from that verbal order.
Revision Cycles Revision cycles generally consist of revised artwork that incorporates the changes requested by you in your Revision Brief. The purpose of the revision process is to create Responses that move your project forward in the specific direction you have determined. You may request significant changes in the first and second cycle. By the third revision request, your requests shall be modifications of the current composition only.
Colours For the colours in your logo, it is your responsibility to supply us with the right CMYK codes. Variation is inherent in the print process and it is understood and accepted as reasonable that Moxja shall not be required to guarantee an exact match in colour or texture between the customer’s photograph, transparency, proof, electronic graphic file, previously printed matter or any other materials supplied by the customer and the printed article.
Payment Invoices from Moxja to you for our services should be paid in full on receipt of invoice within two weeks. Our fee policy for Clients may change and we may decide to impose additional fees on Clients at any time; however, such additional fees will not apply to projects submitted before Moxja implements any such change in fees.
Project Duration. Design turnaround times which are quoted to you are normal target times only and Moxja accepts no liability for failure to meet these times, but will use its best endeavours to do so. Turnaround is measured in Working Days.
ADSL data Moxja is not responsibility for loss of earnings to you for untransmittable ADSL data. It is your responsibility to ensure the receiving end of the ADSL transmission has an active compatible computer. It is also your responsibility to ensure the correct ADSL address is given to Moxja.
Force Majeure Moxja shall be under no liability if it shall be unable to perform any obligation which is owed by it to the customer for any reason beyond his control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the customer may by written notice to Moxja elect to terminate the contract and pay for work done and materials used, but subject thereto shall otherwise accept delivery when available.
